Introduction
These Terms & Conditions of Sale (“Terms”) govern the sale of products and services by Royal Granite of SC, LLC (“Royal Granite,” “we,” “us,” or “our”) to you, the customer (“Customer,” “you,” or “your”). By placing an order with us, you agree to be bound by these Terms. Please read them carefully before purchasing any products or services.
Orders and Acceptance
All orders are subject to acceptance by Royal Granite of SC, LLC. We reserve the right to refuse any order at our sole discretion. Upon receiving an order confirmation, the sale is considered accepted, and the contract is formed. Any modifications to the order must be communicated in writing and approved by Royal Granite.
Pricing
Prices for products and services are listed on our website or provided in a quote or invoice. All prices are subject to change without notice. Prices are exclusive of taxes, shipping fees, and installation costs, which will be added where applicable. Royal Granite of SC, LLC reserves the right to correct pricing errors at any time.
Payment Terms
Unless otherwise specified, payment is due upon receipt of the invoice. We accept payment by credit card, check, or other methods as agreed upon. Royal Granite reserves the right to require a deposit or full payment before the commencement of work. All payments must be made in U.S. dollars.
Late payments may incur interest at the rate of 1.5% per month (or the highest rate permitted by law), calculated from the date the payment was due until the full payment is received.
Cancellation and Changes
Orders may not be canceled or changed without the prior written consent of Royal Granite. If you wish to cancel an order after it has been confirmed, we reserve the right to charge for any costs incurred, including materials, labor, and processing fees. Custom orders cannot be canceled once production has begun.
Delivery and Installation
Delivery dates provided by Royal Granite are estimates only and subject to change. We will make reasonable efforts to meet the delivery date, but we are not liable for delays beyond our control, including but not limited to, delays caused by suppliers, transportation, or unforeseen circumstances.
If Royal Granite is responsible for the installation, we will coordinate installation with you. Any issues related to access or site preparation must be resolved before installation begins. Additional charges may apply if installation is delayed due to Customer’s failure to prepare the site or provide adequate access.
Inspection and Acceptance
Upon delivery, you must inspect the products and notify Royal Granite of any defects or discrepancies within 48 hours. Failure to provide notice within this time frame will constitute acceptance of the products. If defects are reported, Royal Granite will, at its discretion, either repair or replace the defective items.
Warranty
Royal Granite of SC, LLC offers a limited warranty on our products and services, as outlined in the warranty document provided with your purchase. The warranty covers defects in materials and workmanship for the specified period. The warranty does not cover damage caused by misuse, improper installation by a third party, or lack of maintenance.
Returns and Refunds
Royal Granite does not accept returns on custom-made or special-order products. Standard items may be returned within 30 days of delivery, subject to a restocking fee of up to 25%. Items must be in original, unused condition. Refunds will be issued after the returned item has been inspected and approved.
Shipping costs for returned items are the responsibility of the Customer, unless the return is due to a defect or error on our part.
Limitation of Liability
To the fullest extent permitted by law, Royal Granite of SC, LLC shall not be liable for any indirect, incidental, or consequential damages arising out of the sale, installation, or use of our products. Our total liability for any claim related to the products or services provided will not exceed the amount paid by the Customer.
Governing Law and Dispute Resolution
These Terms are governed by the laws in the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or related to your purchase shall be resolved through good-faith negotiations. If negotiations fail, the dispute shall be submitted to binding arbitration in Horry County, South Carolina.
Force Majeure
Royal Granite of SC, LLC shall not be liable for any failure or delay in performance due to causes beyond our control, including but not limited to acts of God, war, pandemics, labor disputes, shortages of materials, or government regulations.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with any written agreements or documents referred to herein, constitute the entire agreement between Royal Granite of SC, LLC and the Customer, superseding any prior agreements, understandings, or communications related to the sale of products or services.
